I pay contractors to the roof done and it not pass city inspection

So I got the agreement paper that said what they supposed to do a lot of things and they don’t even do as they said and they don’t pull the permit. Also city inspector come and it not even pass the inspection.

  1. I am supposed to pay this roof? Because I got to redo the whole roof again due to the old decking spacing also a lot of nail that they put to the shingles it go directly though the gap not even on the woodmy roof again ?

  2. Can I just tell them to come get they roof off smh

They also told in the agreement that they will replace a decking but look to me like they don’t even do it.

I’m so confused right now.

If they did not apply for a permit, how did the city inspector know to come out?

Roofing company failed to meet agreement, didn’t pass inspection. Roof needs redoing due to spacing and improper nailing. Consult legal help or ask company to fix issues. If not resolved, discuss roof removal with them. Keep evidence.

You should first review whatever contract you signed, then send them a letter certified mail that they have failed to provide the roof as agreed in the contract since you have a reasonable expectation that the roof would be permitted and pass inspection. Then give them a reasonable period of time to correct the roof. Keep a copy of the letter and keep the certified mail delivery receipt.

If roofers are licensed in your state also request a copy of their license and a copy of the permit they need to file for your roof with the city.

Make sure you communicate with the city inspector the steps you are taking to get it corrected.

If you haven’t paid them at all yet, then obviously don’t pay until the roof passes inspection.

If they don’t make it good then you will have to find another contractor to do the work. Just make sure you send them notice that you will be finding another contractor and they won’t be getting paid. Keep a copy and certified mail again.

If you have already paid part of the cost you will have to talk with a lawyer and see about getting the money back.

Now if it is true that the roofer cant correct the roof to pass the inspection…should he be paid??
I havent been in that position before.
I have failed several final inspections.
Always got them corrected and passed also!

Im afraid you are overacting.
They DID pull a permit
Or the inspector wouldnt have come.
I am feeling confident the roofer has corrected the inspectors needs and has passed inspection.
The roofer did replace decking.
He also installed all new radiant barrier osb decking on top of the existing decking.
You have someone that really cared.
