I submitted supplements to Homeowners of America for an insured a few days ago. One of the line items was for supervisor/project manager hours. Now, mind you, this was an additional supplement due to height, steepness, difficulty access to the home, etc.
The adjuster wrote back on that line item and stated that OSHA does not have jurisdiction over subcontractors. I don’t feel this is correct since we both (GC and subs) have to both abide by OSHA standards/requirements. I can’ find any DIRECT documentation stating so, but it’s all a bit of a grey area.
Have you ever received this response before? If so, how did you overcome it?
